If you remove the hard drive you can mount it in an external USB HD enclosure and access all the data on your new laptop.

I did this, transferred any data that I wanted to keep and now use the external HD to record films on to play back on USB enabled TV when away in the moho.

Well what a turn up! I bought a new Macbook Air using the money from my insurance company, put the damaged one on eBay, and would you believe it got £275 for it. So a brand new one cost me £374 instead of £1099.... Result. Oh! less eBay and paypal fees.
I know some people think Apple computers are overpriced and not worth the money but I'm dead chuffed with mine.
