After countless poor experiences with Marquis, this one tops them all.

My 'van went into Marquis Sussex for some warranty work on the diesel heater, after them having it for 2 weeks it went to the eberspacher service centre and was rectified. I now learn that without my knowledge or consent, Marquis had the service centre carry out a service on the heater in order to honour the warranty (the problem occurred befoe it was due a service but it took Marquis 8 months to get it to the centre!) and Marquis have now sent me the bill for it.

I rang up and refused to pay it and now Marquis Sussex are refusing to carry out any warranty work on my 'van.

Now I'm reasonably up on these things and believe that:

1. I didn't ask them to carry out the service, wasn't asked about it and never signed anything so believe that Marquis are responsible for this bill. Is this correct?

2. Marqius are obliged under contract to honour the warranty without condition (other than those specified ie annual motorhome service).

The workshop manager alleges that the instruction not to carry out warranty matters came from the MD, who is conveniently out of the country. I am waiting on a call from the after sales manager.

You views are appreciated. (Especially those qualified in law)

Andy

Sounds like a typical tale of the big boys throwing their weight around for no reason whatsoever.

I've got absolutely nothing constructive to add to this thread, but I just wanted to give you my sympathy at being treated like pondlife.

Incidentally, I'm extraordinarily excited about heading to the Suffolk coast this weekend. Bring it on!

It's cases like yours Andy that make me wish I'd become a lawyer but perhaps they are trained to go for simple justice not the blood-stained revenge and public flogging that I'd want.

Hope someone comes along soon who can offer more concrete advice. I'd be tempted to do a pre-emptive strike and ring the Head Honcho of Marquis UK and insist on dealing with him alone.

G.

Bad news and seems to me a totally unnecessary attitude. I think we ought to have a section on here for unreliable companies and then email them the link.

We could have a poll and email the results to them e.g.

Would you buy a motorhome of Marquis after reading this post or are you happy to be treated like dog poo. Certainly will attach my name to one.

Go for it Pusser. Good idea, maybe it's time to throw some people power about.

Mike Crouch is the MD. He has always replied to my letters in the past however, on each occassion he refers me to the manager of Marquis Sussex who is one of the problems!!

Hello

Disgusting attitude on Marquis' part. First put in writing what you have posted here and tell them as they did not consult you then they must foot the bill. Secondly if their attitude is as you say I wouldnt want any work done by them anyway. i wouldnt trust them. If its an Autosleeper van go to Autosleeper.

Also I would contact your local trading standards for their advice. Good luck & hope it all gets sorted soon.

Hi sorry to here of the problems you are having, I am having similar with Chelstons of Wellington over my Bessacar 765 they have had it for over two months now and this is the fourth time it has been back. I have found Consumer Direct quite helpful as has Bob been from MHM. As I understand it a third party cannot arrange work to be carried out on someone elses property with out their (Written) permission and as such you should not be liable for any costs however caused. Under most warranties items must be of suitable durability for the purpose to which they are used and provided that the items have been serviced as per Makers instructions no liability should be incurred to yourself. Bearing in mind that if a commercial enterprise sells anything that is powered by gas or flammable liquid it has to have been inspected and its history of service supplied at point of sale or if no history is available to have been serviced as per makers standard. Combustible liquid burning Carbon monoxide producing items. If Marquis is refusing to honour their warranty obligations following this problem they are in breach of contract as per the sale of goods act and by offering goods or services knowing that information they provided to effect a sale is false as in not honouring the warranty, could be seen as a percunary advantage by deception.Best of luck Weldted.
