Why not make a video driving a mile or so with the switch in one position and then the other and show that you don't get a text with either setting. That clearly demonstrates that it does not work.

I would email the video to the company along with a letter saying that this clearly demonstrates that their product does not work and is what you will rely in if the matter goes to court. In that way you will be able to show a court or tribunal that you took every possible step to have the matter settled before taking legal action. I would make much of that as courts and tribunals take a dim view of having their time wasted.

I doubt you would need to show the video as surely the supplier would realise that they can't win, Alan.

As far as I can see from this thread, you have a system which is dependant on a PAYG sim to operate. If this is so, then you would need to confirm that the sim is active before proceeding to court. If the sim is not active, because for example the credit has run out then a system will not be able to contact you. I would be very suprised if you didn't receive any paperwork, and if you did the network and phone number of the sim should be shown somewhere. If you can find this information any shop dealing with the network should be able to check the sim status.

It is active, because it sends a text if you disconnect the battery. But it never sends a text if you drive the van.

Interestingly, I have just got a quotation from MHF Insurance, and the Falcon tracker from Electronics Worldwide is NOT an insurance authorised tracker, and does not allow me a discount for having a tracker. So my quote is as if I have no tracker at all.

Update......

I have filedl lawsuit against Electronics Worldwide and Lloyds TSB joint defendants.

I wrote and explained position to Electonics Worldwide.

They don't seem to take it v seriously, but after my letter I got an e mail suggesting an engineer might visit to work out why the tracker was not working..... something I've been asking for for months.

They have been rather slow about it, but I have filed at the court for one month's stay, in case they can work it out.

I explained to them that they have ignored all my letters, hence me paying £60 court fee to file the claim, and that they continued to ignore them so I have paid a further £40 on the court allocation questionaire, and have explained that since it took a court case to get them to even answer me, I'll expect a refund of £100 court cost....... they have ignored this.

It seems the engineer is a third party, as are all the other parties in their side of the transaction.

Well, I can tell you something for nothing.... do not part with money at shows!!!! Not even NEC. The stronger the salesman..... etc

Well the engineer came.....

and guess what? the tracker doesn't work properly.... it does not send any texts when the ignition is switched on or the van is moved..... and it does not send any texts when the panic button is pressed.


The engineer was very nice, but didn't work for the company.

The company were on the phone - after an hour when it wouldn't work they concluded that "the tracker is working".

Both the engineer and I said "well it may be "working" but it is not working properly and in the most important respects".... but guess what? They wouldn't listen and talked over us and then hung up.

They have not contacted me since.

The nice engineer allowed me to video taped the testing of the tracker and showing it not working... so I have evidence which I can use to prove this.

So it's onto court.

What a palava. I just don't understand why a company in the business of providing "confidence" and "security" would be so completely useless at fixing a tracker which patently doesn't work as it's supposed to.

Interesting read. If you are at the stage of having proven it doesn't work and that the company is ignoring any requests to sort the system out. Short of a baseball bat I would cut my loses. Chasing it through court won't guarantee a good outcome. Companies like this can close on Friday and reopen on Monday under another name. Give Anne Robinson a call!!

The credit card company are joint defendants, so they have to pay up even if the company goes bust.
