I am sure most people know by now about the demise of Transleisure,
so I won't bore you with my wows.
However, I was on to my Credit card company today to find out if I could get my deposit back through them.
This is what a very helpful lady told me;
If you pay by credit card you get 120 days from when the card is debited to make a claim.
However if you use your card to pay a deposit for part or services that are going to be fitted after the 120 day deadline, then you must get a written and signed letter stating when the service / parts will arrive. If you do that the the 120 day deadline starts from that date.
So if anyone else intends using their credit card to pay a deposit on a new MH or for that matter anything that won't arrive for three months or more get the supplier to put the delivery date in writing. If they go bust or default you can then get your money back from your credit card company.
I didn't and its cost me £1000. so I hope the info is some help to other members

Interesting point, Wobby. Didn't know about those conditions. Sorry to hear of your problems; hope it's resolved soon.
As an aside, I note you're in Ireland; is this a condition imposed by the Irish banks / cc operators? , and does anybody know if this applies in the Uk as well?

Sorry to hear that Wobby, and many thanks for bringing it to everyone's attention, I'm sure a lot of us were not aware of this.
Is there any way you could point out to them showing your motorhome order that you/they(TL) were fully aware that the item wasn't going to be supplied for 11 months when the new motorhome arrived.
I think for £1000 it's worth making a bit of fuss with the CC company

The time limit may be a term imposed by the credit card company but in the UK at least the credit card issuer is jointly liable with the supplier in the case of ......breach of contract and I do not believe there is any such time limit under the Act.
You may not be entitled to the protection under the act in Ireland but I would have thought that this would be an EU requirement. I am sure others on this list will know more

Consumer Credit Act 1974 (CCA74) this is the one that covers credit cards.
2. The law of limitations says that a claim cannot be made after a period of 6 years. However it is generally recognised that the 6 year period starts from the time that you became aware of (or ought to have become aware of) the non delivery.

That's a bad bit of luck. However Waggy's point has a lot of merit. The credit card company are telling you "their rules" however your "Trading Standards" office (don't know what you call them there?) will tell you what the law says the Credit Card company's liability is.
