There is a letter in this months MCC magazine regarding an e-bike user who was in collision with a bus. He is being prosecuted for having no insurance as it has been 'classed' as a road vehicle not a bycycle. 200watts power has been mentioned.
Does anyone know the actual requirements of the classification as a road vehicle or a bycycle and how you would go about obtaining compolsory insurance if it was deemed required. Would it be subject to an MOT or licence regulations?
I'm pretty sure, but the bikes sold in the UK are under a particular power level, are restriced so they can't go over 15mph, and are not required to have insurance (and be registered as road vehilces). Presumably if they are under that power level they would be classed as normal pedal cycles?

I have just read that letter in the MCC mag too....but did you take in that the story is second hand? It is a letter from a MCC member who says he saw the story about the electric bike user in a copy of the Motor Cycle News and the story is related in the MCC mag ...but it is just a story with no refrence ...and the editorial attached is suspect too.
I have already searched the Motor Cycle News for the story ... I cannot find it in any of their recent editions... so it may be case of scaremongering
it includes reference to 250 watt motors...like what we have

The item in the MCC magazine used the word "summoned" as in
" I have been summoned in connection with a bike I was riding that was involved in a collision with a bus. The bike is an e-bike ( electrically assisted bike) and I was assured by the suppliers that it was road legal as a cycle not a motor vehicle"
and as such they are saying that as he is being prosecuted by the law ... but it is only heresay as the original story came from the Motor Cycle News ...and we do not know if it was an actual news story or if it was seen in their online forum ... as we all know all sorts of daft and, shall we say, "innocently inaccurate" stuff gets said on internet forums

Yes, the assumption being that he is "being prosecuted by the police"; that it is a criminal matter. But if you damage someone else's property without committing a criminal offence you could still be "summoned" to appear before the court as a civil matter.
The "electric" bit is bye-the-bye anyway I think; as a cyclist, electric or not, I can commit criminal offences for which I could be prosecuted.
Anyway, best not to cycle on the roads in the UK anyway - far, far too dangerous. Give me an alpine descent any day ...
